We reserve the authority, according to our absolute assessment, to limit the user's right to log in or suspend or terminate their use without prior notice and for any reason, including violating the terms of use or any action we may deem illegal or harmful to others. You will not be allowed to log in to the platform during this termination.
Except as provided for by law, personal data may not be processed, or its purpose changed, except with the owner's consent. Regulations specify the conditions for consent, the circumstances in which consent must be written, and the terms and conditions related to obtaining the consent of the legal guardian if the data owner is incomplete or incapacitated. However, consent may not be a condition for providing a service or benefit unless the service or benefit is related to the processing of the adopted personal data.
Feedback and Electronic Participation Standards
All comments on electronic participation channels or social networks are carefully reviewed to ensure users adhere to the standards and regulations related to commenting. This platform has the authority to exclude any comments deemed inappropriate, and users are required to:
- Respect general ethics and avoid any inappropriate language or use of unrefined words.
- Keep comments relevant and focused on the discussed issue.
- Avoid bias and personal criticism that does not enrich the discussion.
- Ensure accuracy when referencing Quranic texts or religious opinions, allowing only specialists to discuss such topics.
- Avoid sharing personal information, such as contact details, within the comments.
Any other modifications to the terms of use will be applied immediately upon announcement, unless stated otherwise.
Data Breach:
Maee.gov.sa must notify the relevant authority as soon as it becomes aware of a personal data breach or unauthorized access. Additionally, if any breach is likely to cause serious harm to your data, the entity will notify you immediately.
Communication:
Except for informational materials sent by public entities, Maee.gov is not allowed to use personal contact methods, including email and postal addresses, to send advertising or informational materials unless:
- The targeted recipient's consent is obtained to send such materials.
- The sender provides a clear mechanism, as defined by regulations, allowing the targeted recipient to express a desire to stop receiving such materials whenever desired.
- Except for sensitive data, personal data can be processed for marketing purposes if collected directly from the owner and agreed upon under the provisions of the law.
Furthermore, your personal data may be collected or processed for scientific, research, or statistical purposes without your consent in the following cases only:
- If the personal data does not include evidence of your identity.
- If your identity is destroyed during the processing and before disclosing it to any other party, and this data is not sensitive.
- If the collection or processing of personal data for these purposes is required by another system or to fulfill a prior agreement in which the Kingdom is a party, or for purposes specified by regulations, provided that the following conditions are met:
• The transfer or disclosure does not compromise national security or the vital interests of the Kingdom.
• Adequate guarantees are provided to maintain the confidentiality of the personal data to be transferred or disclosed, ensuring that the standards of personal data protection are not less than those provided by the law and regulations.
- The transfer or disclosure is limited to the minimum personal data necessary.
- Approval of the competent authority for the transfer or disclosure, as specified by regulations.
- Except for the condition stipulated here, the competent authority may exempt Maee.gov.sa, on a case-by-case basis, from compliance with any of the conditions when the competent authority, individually or jointly with other parties, assesses that the personal data will have an acceptable level of protection outside the Kingdom, and this data is not sensitive.
This platform retains records for a period determined by regulations, including:
- Contact details for the entity.
- Purpose of processing personal data.
- Categories of subjects of personal data.
- The party to whom the personal data has been disclosed (or will be disclosed).
- Whether the personal data has been transferred (or will be transferred) outside the Kingdom or disclosed to a party outside the Kingdom.
- The expected retention period for personal data.
Crimes and Penalties:
Without prejudice to any stricter penalty specified in another law, the penalty for committing the following crimes is as follows:
- Imprisonment for a period not exceeding (2) years and a fine not exceeding (three million) Saudi Riyals, or either of these penalties if done with the intention of harming data owners or achieving personal benefit.
- Imprisonment for a period not exceeding (one year) and a fine not exceeding (one million) Saudi Riyals or either of these penalties for anyone violating the provisions of transferring personal data or disclosing it outside the Kingdom.
In the absence of a specific provision in the law and without prejudice to any stricter penalty specified in another law, any individual or legal entity violating provisions of the law or regulations is subject to a warning or a fine not exceeding five million Saudi Riyals. The fine may be multiplied in case of repeated violations, even exceeding the maximum limit, if it does not exceed twice this limit.
The Public Prosecution is responsible for investigating and prosecuting these violations. The competent court considers cases arising from the application of this article and imposes the prescribed penalties.
A committee (or more) with members not less than three, including one designated as the chairman, and including a legal or Sharia advisor, is responsible for reviewing violations and imposing the prescribed warning or fine based on the type and severity of the committed violation and its impact. The chairman of the relevant authority issues a decision approving the committee's operating rules, specifying the members' fees. Anyone has the right to appeal against the committee's decision before a competent court.
Without prejudice to the provisions of this law, Maei.gov holds any of its employees accountable, disciplinary, in case of their violation of any provisions of the law and regulations, in accordance with the provisions and procedures of accountability and discipline stipulated in the law.
Without prejudice to the penalty imposed by the law, anyone who has suffered damage due to the commission of any of the violations specified in the law or regulations may claim compensation before the competent court for material or moral damages proportionate to the extent of the damage.
Moreover, anyone who begins processing personal data is obliged to maintain the confidentiality of the data even after the end of their employment or contractual relationship.
